PreventionTracking – Terms & Conditions

These Terms and Conditions (“Terms”) govern the use of all products, platforms, devices, and services provided by PreventionTracking (“we,” “us,” or “our”). By purchasing, activating, or using our services, you (“Customer,” “Client,” or “You”) agree to these Terms.

1. Services Provided

PreventionTracking provides GPS tracking, telematics, mobile data services, IoT device management, communication services, and related software platforms. Services may include:

  • Real-time GPS tracking
  • Telemetry and reporting features
  • Device provisioning and support
  • SMS / alert notification systems
  • Vehicle or asset monitoring tools
  • PoC (Push-to-Talk-Over-Cellular) communication devices
  • Administrative and dispatch management portals

Service availability may depend on cellular network coverage, device compatibility, and third-party infrastructure.

2. Customer Responsibilities

You agree to:

  • Provide accurate and updated customer information
  • Maintain devices in proper working condition
  • Ensure equipment is used for lawful purposes only
  • Follow all applicable laws regarding tracking and monitoring
  • Pay all service fees on time

You are responsible for any misuse of devices or systems under your account.

3. Payment Terms

  • All invoices must be paid within 10 days of the invoice date unless otherwise specified.
  • Accounts past due 30 days may be suspended until payment is made in full.
  • Service interruptions due to non-payment do not remove your responsibility for outstanding charges.
  • All hardware, devices, or accessories must be fully paid before warranty or replacement support is provided.

PreventionTracking reserves the right to charge fees for reactivation, late payment, or returned payments.

4. No Warranty Without Invoicing / Serial Numbers

For warranty coverage:

  • All devices must have an official PreventionTracking invoice.
  • Devices must have a visible serial number and must match our records.
  • If the manufacturer does not recognize a defect, no warranty will be provided.

Warranty applies only to approved manufacturer defects and does not cover physical damage, misuse, or unauthorized modifications.

5. Network & Service Limitations

Service availability depends on third-party networks such as:

  • Rogers, Bell, Telus (Canada)
  • AT&T, Verizon, T-Mobile (USA)
  • International cellular carriers (if applicable)

PreventionTracking cannot guarantee coverage in all areas and is not responsible for outages caused by cellular carriers.

If service requires switching to a different provider, pricing may need to be renegotiated because each carrier charges different wholesale rates.

6. Data Privacy & Mobile Information

Your data is protected according to our Privacy Policy.

We do not sell, rent, or share:

  • Personal information
  • Mobile numbers
  • SMS opt-in or consent data
  • Tracking or location records

Data is used solely for service delivery and account management.

7. Device Activation & Usage

  • Devices must be activated on our platform before usage.
  • SIM cards, data plans, and credentials remain the property of PreventionTracking.
  • Removal, tampering, or unauthorized switching of SIM cards voids support and warranty.
  • Device performance may vary depending on installation quality, environment, and signal strength.

8. Service Interruptions

We strive for high uptime, but we do not guarantee uninterrupted service.

Interruptions may result from:

  • Carrier outages
  • Device malfunction
  • Environmental interference
  • Maintenance or upgrades
  • Third-party system failures

PreventionTracking is not liable for any damages or losses caused by temporary service interruptions.

9. Liability Limitation

To the fullest extent permitted by law:

  • PreventionTracking is not liable for indirect, incidental, or consequential damages.
  • We are not responsible for loss of business, revenue, profits, or data.
  • Our total liability for any claim will not exceed the total amount paid by you for services in the previous 3 months.

Tracking devices and software should be used as support tools, not as guaranteed safety or security systems.

10. Cancellation & Termination

  • You may cancel service with written notice as per your contract terms.
  • Prepaid periods are non-refundable.
  • PreventionTracking may suspend or terminate service for non-payment or policy violations.

Devices must be fully paid before cancellation is finalized.

11. Ownership of Software & Platform

All software, portals, firmware, and data dashboards remain the sole property of PreventionTracking or its licensors.

You receive a limited, non-exclusive license to use the platform for your business purposes only.

Unauthorized copying, reverse engineering, scraping, or exporting of system data is prohibited.

12. Updates to Terms

PreventionTracking may update these Terms at any time. Updated Terms will be posted on our website or sent via email. Continued use of the service after such updates indicates acceptance.
